Terma Program Affiliate

1. Parties and acceptance
These Affiliate Program Terms (“Terms”) are an agreement between Splashbros Pte. Ltd., a company incorporated in the Republic of Singapore that owns and operates Daymaster (“Daymaster”, “we”, “us”), and the person or entity applying to the Daymaster Affiliate Program (“you”). Contact: sales@splashbros.games.
You accept these Terms by ticking the acceptance box on the application form. We keep a permanent record of every acceptance: the version and a fingerprint of the exact text you accepted, the date and time, and the browser information your device sent. We keep that record after your participation or your account ends, for as long as it may be needed to establish, exercise, or defend legal claims. When we make a material change we publish a new version here and ask you to accept it again before you can mint new links or request a payout; your statistics and balance stay visible in the meantime. Continued participation after you accept the new version constitutes agreement to it.
These Terms supplement the Daymaster Terms of Service and Privacy Policy, which also apply to you as a user. Where they conflict on a matter concerning the program, these Terms prevail.
Our decisions are final. Every question about the program — including approval and eligibility, attribution, whether a purchase qualifies, the amount of any commission, clawback, adjustment, or payout, whether any conduct is fraudulent or in breach of these Terms, the timing and method of any payout, and the meaning of these Terms — is decided by us in our sole discretion, and our decision is final and binding on you. We need not give reasons. Our attribution, click, ledger, payout, and acceptance records are conclusive evidence of what they record, absent manifest error. Nothing in this section takes away a right that the law does not allow to be excluded.
2. Eligibility
You must be at least 18 years old, have the legal capacity to enter into a contract, and hold a Daymaster account in good standing. If you accept on behalf of a company or other entity, you confirm that you are authorised to bind it. You must not be subject to sanctions that would prevent us from paying you.
Every application is reviewed by a person. We may decline an application, or later end participation, at our discretion and without giving a reason; declining is usually about channel or audience fit. You must keep your application details and your account details accurate.
3. The program and qualifying purchases
The Daymaster Affiliate Program pays a revenue-share commission on qualifying cash purchases made by users you refer. The standard rate is 20% of each qualifying purchase. Commission is held for 30 days to cover refunds, and can be paid out once it is at least 60 days old (section 5). Individual rates, the range within which a rate may move, and hold periods are set per affiliate at our sole discretion and may be changed by us at any time on notice, for purchases made after the change. Commission accrues only on a referred user’s qualifying purchases made within 12 months of the date that user created their Daymaster account; purchases after that date earn no commission, even though the referral stays in your statistics.
Referred users are our customers. They receive exactly the same product, prices, and treatment as every other Daymaster user, and nothing we show them indicates that they arrived through an affiliate. You must not offer or promise a referred user any discount, bonus, reward, rebate, gift, or special treatment, whether from us or from you.
A “qualifying purchase” is a completed one-time cash purchase made through Stripe by a referred user, measured as the amount actually charged after any discount or coupon, less any tax collected on it and less the payment-processing fee our payment processor retains on that charge. Where the processor has not yet reported the fee when commission is recorded, a standard estimate is used instead and shown on the ledger entry. Purchases paid with coins, coins we grant, subscriptions (unless we expressly enable them for the program), refunds, chargebacks, and any purchase we void as fraudulent do not qualify.
4. Attribution
A referral binds when a NEW account (created within 72 hours) signs in after following your link. The account binds to the link whose referral cookie was present on the device when the account was created or first signed in (we record it on the account at sign-up, so confirming your email on another device does not lose it) — if the visitor followed several affiliates’ links, the most recent cookie wins — and the binding is then permanent: one account binds to at most one affiliate, forever, and existing accounts never re-bind. Our attribution records are the sole record of which users are referred to you.
Your link sets a referral cookie on the visitor’s device for 30 days. A visitor who declines marketing cookies in our consent banner is not attributed to you, and no commission or compensation is due for such visitors. You must not attempt to bypass, forge, or extend the cookie.
You may never be your own referral, may not refer accounts you control, and may not fund, reimburse, subsidise, or otherwise pay for any part of a referred user’s purchase. Each person or entity may hold one affiliate account; duplicate accounts are void. Self-referral attempts are logged, void, and grounds for suspension. We may verify any referral and any traffic — including by correlating referred sign-ups with the network addresses your own portal sessions use, and by asking you for evidence of how a referral was made — and we may void commission that we reasonably determine to be fraudulent, manipulated, or in breach of these Terms.
5. Commissions, holds, clawbacks, and disputes
Commissions are held for the configured hold period (default 30 days) before they count toward your balance; a payout then includes them once they are at least 60 days old, as set out in the next paragraph. The hold is deliberately longer than the refund window in our Terms of Service, so that an ordinary refund lands before the commission on it counts toward your balance. If a referred purchase is refunded in whole or in part, the corresponding commission is clawed back proportionally. If a referred purchase is charged back or disputed with the card issuer, the corresponding commission is reversed in proportion to the disputed amount when the dispute is opened, and restored only if the dispute is decided in our favour. Clawbacks apply after payout as well, in which case the negative balance offsets future earnings.
Payouts (PayPal and Stripe) cover only commission that is at least 60 days old, so that a card dispute — which can arrive up to about 120 days after a charge — cannot follow money we have already sent. If any referred purchase is charged back, your payouts are paused while we review your account — commission keeps accruing — and are resumed when the dispute is decided in our favour or our review clears you. If your clawbacks reach 30% or more of everything you have earned over three or more sales, your participation is suspended automatically pending review.
Our ledger is the authoritative record of commissions, clawbacks, and payouts. If you believe an entry is wrong, tell us in writing through a support ticket within 30 days of the entry; entries not disputed within that time are final. We will review disputes in good faith; our determination is final and binding (section 1).
6. Payouts, currency, and fees
Payouts are requested from your dashboard once your payable balance exceeds the minimum for your chosen method. There are two methods, both of them cash: PayPal, made in US dollars to the PayPal email on your profile; and Stripe, transferred to a Stripe account you connect and Stripe pays out to your own bank. The Stripe method is available only to affiliates whose country of tax residency our payment processor lets us pay (currently Singapore); everyone else is paid by PayPal. Both are reviewed and sent by an operator, typically within five business days of your request — this is a target, not a guarantee. Any fees, currency conversion, or charges imposed by PayPal, Stripe, your bank, or your country are borne by you. Commission is no longer paid in Daymaster coins, and we no longer arrange payouts by private bank transfer.
Before your first payout we ask you to confirm your country of tax residency and whether you are a US person, and we may withhold payment until you do. On the Stripe method, Stripe additionally collects and holds the identity and tax documents it requires (such as a W-8BEN or W-9) and issues any information return that is due; we do not store your tax identification number on either method. We may withhold or reverse a payout while we review suspected fraud or a breach of these Terms.
We may decline to pay you where a payment to you or to your country would be unlawful for us, would be blocked by sanctions, or cannot be made by any payment processor available to us. If neither method can reach you, we will tell you, and any balance stays yours to claim under the time limit below for as long as a lawful route exists.
We may deduct from any commission or balance any amount you owe us, including clawbacks, overpayments, and any loss arising from your breach of these Terms.
If you leave the program, delete your Daymaster account, or your participation is ended without cause, you must request any payable balance above the applicable minimum within 90 days; balances not requested within 90 days, and balances below the minimum, are forfeited. Balances are forfeited immediately on termination for cause. Because a payable balance may still be owed to you after you delete your account, we keep your payout email and your ledger for as long as needed to settle it and for the statutory record-keeping period (see section 11).
7. Independent contractor and taxes
You participate as an independent contractor. Nothing in the program creates an employment, agency, partnership, joint-venture, or franchise relationship, and you have no authority to make commitments on our behalf. You are not entitled to any employee benefit.
Commission is paid gross. You are solely responsible for determining, reporting, and paying any income tax, goods and services tax, VAT, or other tax that applies to it in your jurisdiction, and for any registration those taxes require. Where law obliges us to withhold tax or to report payments, we will do so and the amount you receive is reduced accordingly. You agree to provide the tax and identity information we reasonably request for this purpose.
8. Disclosure and marketing-law duties
You must clearly and conspicuously disclose your material connection to Daymaster wherever you share affiliate links, as required by the FTC Endorsement Guides and equivalent rules in your jurisdiction (e.g. “#ad”, “affiliate link — I earn a commission”). Disclosures must be unavoidable, not buried in profiles or link aggregators. The copy templates in your portal come with their disclosure written in; keep it.
You must comply with each platform’s own promotion rules (YouTube, TikTok, Instagram, 小红书, WeChat, etc.) and with all applicable advertising, consumer-protection, anti-spam, and privacy laws. In particular: you may send commercial electronic messages only to recipients who have consented to receive them; you must never send unsolicited messages promoting Daymaster to Singapore telephone numbers without checking the Do Not Call Registry as the Personal Data Protection Act 2012 requires, and you must comply with the Spam Control Act 2007 and the equivalent rules where your recipients are (CAN-SPAM, PECR, GDPR and others). You are the controller of any personal data you collect from your own audience and responsible for it.
You must not make health, medical, financial-return, or outcome guarantees on our behalf, and you must not misrepresent what our readings are: they are reflective guidance for entertainment and cultural education, not professional advice.
9. Brand assets and content licence
While you participate in good standing, we grant you a limited, revocable, non-exclusive, non-transferable licence to use the Daymaster name and the banners, images, and copy we provide in the portal, unmodified except as the portal allows, solely to promote Daymaster under these Terms. We may withdraw the licence or any asset at any time by notice, after which you must stop using it within seven days.
You must not register or use domain names, social-media handles, app names, email sender identities, or trade names that contain or imitate “Daymaster”, “日主”, or our other marks; bid on our brand terms or misspellings in paid search; present your site or content as an official Daymaster property; or imply that we endorse you, your content, or any third party.
10. Prohibited conduct
The following void commissions and end participation: self-referral or referring accounts you control; funding, reimbursing, or subsidising referred purchases; holding more than one affiliate account; cookie stuffing, forced clicks, iframes, or any attribution manipulation; browser extensions, toolbars, or software that inject, replace, or extend referral cookies; operating or promoting through cashback, coupon, loyalty, or other incentive sites or programs that pass any part of your commission to the buyer; offering or promising referred users any discount, bonus, reward, or special treatment; bidding on Daymaster brand terms or misspellings in paid search; representing yourself as Daymaster or using our name or logo in domains, handles, or sender identities; spam in any channel; incentivised, purchased, or fraudulent signups or purchases; making health, medical, financial-return, or outcome guarantees on our behalf; targeting minors, promoting to anyone under 16, or promoting on services directed at children; promoting through content that is unlawful, deceptive, or hateful; and any misrepresentation of what our readings are.
We may require you to remove or change any content, link, or placement within 48 hours of our notice; failing to do so is a breach of these Terms.
11. Data you see, data we keep
Your dashboard shows aggregates only: clicks, signups, purchaser counts, and revenue sums. You never receive referred users’ identities, contact details, or purchase histories, and you must not attempt to identify them. Rates, rate ranges, unpublished program information, and anything marked confidential in the portal are confidential and may not be shared.
We store click telemetry in privacy-reduced form (a salted hash of the IP address, a coarse device class, the referring host only) and delete it 13 months after the click. Your payout details are limited to the PayPal email you provide; on the Stripe method your bank details are held by Stripe and are not stored on your affiliate record. Commission, clawback, and payout records are accounting records that we keep for at least five years after the last entry, as Singapore company and tax law requires, even if you delete your account — in which case your profile is anonymised and only the ledger, your accepted-terms record, and any payout email needed to settle a balance are retained. For fraud detection we also keep a salted hash of the network addresses your own portal sessions come from and correlate it with referred sign-ups; these hashes are deleted 13 months after they were last seen. Our Privacy Policy explains this in full.
12. No guarantee; liability; indemnity
We do not guarantee any level of earnings, traffic, availability of the program or the portal, or that any link will convert. The program and the portal are provided “as is”. To the fullest extent permitted by law, we are not liable to you for any indirect, incidental, consequential, or special loss, or for lost profits or goodwill, or for any failure or error in tracking, attribution, or reporting, and our total liability arising out of or in connection with the program is limited to the commission payable to you in the three months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law.
You will indemnify us against any claim, loss, or cost (including reasonable legal fees) arising from your marketing activity, your content, your breach of these Terms, or your breach of any law or platform rule.
13. Termination and changes
Either side may end participation at any time by notice; you can do so through a support ticket. We may suspend your links, commission accrual, and payouts, without prior notice, while we investigate a suspected breach. On termination for cause, unpaid commission is forfeited. On voluntary exit or termination without cause, matured payable balances above the minimum are paid on the normal schedule subject to section 6. We may discontinue the program at any time on 30 days’ notice by email; commission continues to accrue until the end of the notice period, and matured balances are paid under section 6. We may change, suspend, or discontinue any part of the program — including rates, hold periods, payout methods and minimums, and portal features — at any time; changes to rates and holds apply to purchases made after the change. Sections 1, 5, 6, 7, 11, 12, 14, and 15 survive termination.
We may amend these Terms at any time. Material amendments take effect for you when you accept the new version (section 1); until you do, you cannot mint new links or request payouts, and if you have not accepted within 30 days of publication we may end your participation without cause. Other amendments take effect on publication with an updated date.
14. Governing law and language
These Terms are governed by the laws of the Republic of Singapore. Disputes are resolved first by good-faith negotiation; failing that, they fall under the exclusive jurisdiction of the courts of Singapore, or — by mutual agreement — arbitration at the Singapore International Arbitration Centre (SIAC). Notices to us go to sales@splashbros.games; notices to you go to the email on your Daymaster account.
These Terms are written in English and provided in Chinese for convenience. If the two versions differ, the English version governs.
15. General
Assignment: we may assign or transfer these Terms to a company in our group or to a successor to the business; you may not assign or transfer them, or any commission, without our written consent.
Severability: if any part of these Terms is held invalid or unenforceable, that part applies to the fullest extent the law allows and the rest stays in force.
Entire agreement: these Terms, together with the Daymaster Terms of Service and Privacy Policy, are the whole agreement between us about the program and replace any earlier understanding. No verbal assurance, and no text outside these documents, changes them.
No waiver: our not enforcing a term, or a delay in enforcing it, is not a waiver of that term or of our right to enforce it later.
No third-party beneficiaries: these Terms confer no rights on anyone other than you and us, and the Contracts (Rights of Third Parties) Act 2001 does not apply to them.
Force majeure: neither side is liable for a failure or delay caused by events beyond its reasonable control — including outages of payment processors or platforms, government action, or natural disaster — provided it resumes performance as soon as it reasonably can.
